If you have been in a wreck, here is what you need to do:
AT THE SCENE:
Make sure everyone is okay and dial 911. Ask for police to investigate. Also request an ambulance, if necessary.
If someone is unconscious, do not move them, unless they are in immediate danger.
Do your best to take as many pictures of the scene and all vehicles involved. Get wide angle pictures and close-ups. If you can take a picture of the other driver, that is good too. Get a picture of the license plates, VIN.
Take a picture of the driver's license and insurance information from the other driver.
Contact your insurance company to let them know a wreck happened, and to start the claims process.
Do not speak to the other driver's insurance company without knowing all the facts of your claim, which include liability, causation, and your injuries. I have listened to recorded statements of people saying they are fine the same day of the wreck, but ended up needing surgery years later because of the wreck.
Talk to a lawyer, know your rights.
Get medical help. The sooner, the better. Delays in getting medical treatment reduce the medical provider's ability to get your back to normal.
Cost of medical services. If you have health insurance, Medicare, or Medicaid, use that coverage to get treatment. If you cannot afford the co-pays or deductibles or if you do not have coverage, then the law allows you to get treatment while the insurance companies figure out who is responsible and for how much. Insurance companies do not pay for treatment until the case is finally settled, which can be years later.
